In the State of Tennessee, rape is defined as the sexual penetration of a victim using force or coercion, without the victim’s consent, where the defendant knows the victim is physically or mentally incapacitated, or accomplished by fraud. There are many forms of rape, each of which demands its own criminal penalties. Rape in its most basic form is a Class B felony. However, if the rape involved force, coercion, or a weapon and resulted in bodily injury or included multiple accomplices, the charge can be elevated to aggravated rape, which is classified as a Class A felony. The criminal penalties associated with rape and aggravated rape can result in:

  • Class A Felony: 15 to 60 years in prison and fines up to $50,000
  • Class B Felony: 8 to 30 years in prison and fines up to $25,000
