Nashville Sexual Battery Attorneys

Tennessee state statutes define sexual battery as unlawful sexual contact without consent with a victim who has been incapacitated in some manner. This incapacitation can fall under several categories such as a force or coercion, or mental and physical handicaps. All cases of sexual battery are felony offenses and carry with them heavy criminal consequences including jail time and expensive fines. A person accused of sexual battery only has a limited time to begin formulating a legal defense so it is imperative that a person charged find legal representation immediately.

At Horst Law, our Nashville sexual battery attorneys are dedicated to defending the rights of all our clients. We believe that no matter what the crime a person is accused of, they have the right to a fair and just trial. Penalties for Sexual Battery

The penalties associated with sexual battery can vary as each of the crime’s multiple forms carries its own punishments. The two most prominent forms of sexual battery include aggravated sexual battery and sexual battery, both of which are felony offenses ranging from class E to class B. Aggravated sexual battery is constituted by unlawful sexual contact that has caused bodily injury, used force or coercion with a weapon, was aided with abetted with multiple people, or the victim was 13 years or younger. Sexual battery alone differs in the sense that the victim did not incur physical injuries and lesser force was used in the sexual contact. Penalties for both of these offenses include:

Aggravated Sexual Battery: Class B Felony, 8-30 years in prison and fines up to $25,000
Sexual Battery: Class E Felony, one to six years in prison and fines up to $3,000

Felonies no matter what the degree are never easy to defend against, but with the proper legal representation, a person accused of sexual battery may be able to see reduced charges or even a full dismissal of the charges.

Testimonials

Mr. Horst’s name was given to me through a mutual friend when I was placed in a situation that I never thought I would find myself in defending myself in a criminal case… His experience and navigation through my case and situation was remarkable… His reputation within the judicial system and when we arrived in court was evident throughout the court employees and the judge the presided over my case as well. My case was retired due to the work that Mr. Horst did and my charges were all dropped. If your searching or need the services of an attorney, you would be doing a disservice to yourself not to call Brent Horst first!

Brent is the best lawyer I’ve come across, hands down! I’ve been through my fair share of lawyers, and he was the only one I found with any sense of urgency and backbone to stand his ground for my case. I battled this felony charge for over half a year until I hired him, and within a few short months he already had it dropped to a misdemeanor with 11-29 probation! I highly recommend him for any of your legal needs! He will get the job done!

I retained Brent for a criminal case. His communication was superlative. He has great respect for the law and his clients. He fought for a new preliminary hearing (PH) after I proceeded pro se in the fist PH and won. He will listen to you (not all will) and he will fight for you (some only give an appearance of this). Brent is a great fighter and person!

Out of all the attorneys I contacted telling them about my case, Mr. Horst was the only that sincerely said “Hey it’s going to be alright.” With what I was going through, those words gave me comfort alone. He fought hard for me, he gave great advice and was very honest. He even payed a portion of my court fees I couldn’t afford and told me not to worry about paying him back. He didn’t treat me as a criminal, he treated me as a human, which is a rare trait in lawyers. He helped me so much, not even sure he knows how much. I would recommend him to anyone.

Brent was always there for me. He is knowledgeable concerning the law and gave me great advise. I would not hesitate to use him again, should my legal situation require an attorney.
